Before you file a small claims case

This is a pre-filing request, not a summons, a court claim form, or proof of service. Check the court's money limit, notice rules, and any required form. Do not assume the court can order repairs or return of property instead of money.

  • Request repayment of a personal loan and account for any partial payments.
  • Ask for an unpaid balance or a refund with receipts supporting the amount.
  • Put a proposed resolution in writing before deciding whether small claims is the right next step.

How to Use This Small Claims Demand Letter Template

  1. Check your court's instructions. Confirm the correct court, claim limit, notice method, and any waiting period. Use an official demand form if one is required.
  2. Explain the dispute and amount. Give the relevant dates and a short account of what happened. List the amounts you are claiming, subtract payments received, and attach supporting copies.
  3. Choose a response date. Follow any required notice period and allow time for delivery and a reply. A date in your letter does not extend the time you have to file a claim.
  4. Finish and send the demand. Remove unused options and replace every placeholder. Keep the sender-record section in your own file, not in the letter you send. Follow the required delivery method.
  5. Keep records and review the next step. Save the letter, attachments, mailing records, and any response. If you later file, follow the court's separate instructions for filing and serving the court papers.

Mailing and Recordkeeping Tips

  • Ask only for amounts you can explain and support. Do not add interest or fees simply because the template has space for them.
  • Certified Mail can provide mailing and delivery information, but it is not automatically the required notice method.
  • Do not contact the other person if a protective order prohibits it. Ask the court or a legal adviser about the proper next step.
